Terms and Conditions

 

1. Limitation of Liability

You expressly understand and agree that neither PT. Amrtasiddhi Pusat Ayurweda Bali (hereinafter referred to as Company) nor its affiliates, directors, commissioners, employees, agents, contractors, clients, or assigns of each, shall be liable for any direct, indirect, incidental, special, consequential, or exemplary damages or other losses resulting from (i) the procurement of any products or services, (ii) information or services obtained or which you were unable to obtain, or (iii) any matter otherwise related to your participation in a program, Ayurvedic treatment, consultation or any other service offered by the Company.

2. Personal Declaration

You confirm that:

• You will truthfully, to the best of your knowledge and as accurately as possible, inform us about your present state of health and your past health history.
• You do acknowledge and understand that although the Company and its staff will execute all services to the best of their knowledge and abilities, the program or service that you have signed up for cannot be a substitute for other medical treatments and/or medications that have been previously prescribed to you by other medical professionals.
• You indemnify the Company and its directors, commissioners, shareholders, employees, agents, affiliates, contractors, clients, or assigns of each against death, injury, illness and all associated losses, damages, claims, actions, suits, demands, interest, and cost arising as a result of your participation in a program or receiving a service offered by the Company.

3. Ayurvedic Programs

Details regarding your program, the program deposit, program fee, your accommodation, and other details are initially stated on your reservation offer and later confirmed in your booking confirmation.

3.1 Program Deposit

The Program deposit is due in full latest 48 hours after we have sent you a reservation offer and the deposit can be paid either through PayPal, Stripe, Credit Card, or cash. The Company issues booking confirmations only after the program deposit payment has been received in full. The Company will release your program slot if it hasn’t received your deposit within the 48-hour deadline and you are not entitled to a program slot or any other services offered by the Company after the deadline has expired.

3.2 Outstanding Program Fee

The outstanding program fee is due in full latest on the first day of your program. We do accept:
(i) Cash (most common currencies – daily exchange rates apply)
(ii) Credit Cards (Amex, Visa, MasterCard, JCB)
(iii) PayPal and Stripe

3.3 Incidental Charges

Incidental charges are charges that occur due to the procurement of services or products that are not part of the standard inclusions of a particular program, for instance, special treatments or special therapies, private tuitions, or herbal preparations for the time after your program. The Company will always inform you of any incidental charges and it will be your choice whether you procure additional products or services or not. Incidental charges will be added to your final bill and you agree to settle all charges latest on the last day of your program and before checking out.

3.4 Program changes by the Company

The Company reserves the right to change the program layout and consulting doctor(s), or postpone your program. In the very unlikely event of the Company postponing a program, you may choose to either attend the same program at a later date or an alternative program (in either option subject to availability). Your deposit will either be refunded in full, or credited to the same program or an alternative program that you choose.

3.5 30 Days Deadline

If you are unable to attend a program that you have booked with the Company, you may cancel or postpone your program. It is mandatory that the Company receives your notification in writing at least 30 days prior to the date your program is set to start (termed “program start” in your reservation offer and booking confirmation), in order for one of the following options to take effect:
• to attend the same program at a different time, subject to availability (replacement program); or
• to attend an alternative program offered by the Company (alternative program); or
• to substitute yourself with another person who must not already be registered in a program with the Company (substitution program); or
• to request a refund for your program payment or program deposit payment. Refunds are free of charge up to 160 days from the transaction date. Any refund request submitted after 160 days from the transaction date is subject to a 4% transaction refund fee plus US$ 60 (+ Vat) administration fee plus the standard PayPal transaction fees.
• replacement, alternative, or substitution programs must start no later than six months after your initial program start date as specified on your initial booking confirmation, otherwise, your deposit will be forfeited.

3.6 Program Cancellations less than 30 days before your Program start

If you are unable to attend a program that you have booked and you notify us in writing or any other way less than 30 days before your program start or if you fail to provide us with any notice of cancellation prior to your program start, 100% of your deposit will be forfeited. There are no refunds, neither partial nor in full, of payments made by you to the Company.

3.7 Program Cancellations on the first day of your Program or later

If you, for whatever reason, cancel your program on the first day of your program or anytime thereafter, you are obliged to pay the full program fee quoted on your booking confirmation. You are not eligible to receive any refunds, neither partial nor in full, of payments already made by you to the Company nor are you eligible for price reductions related to your booked program and other services still due to be paid.

3.8 Program Cancellations by the Company

The Company reserves the right to cancel your program participation including your accommodation in case of serious misconduct from your side or if you breach the Company’s Terms & Conditions or its Rules of Engagement (RoE). You are obliged to leave the Company’s Property immediately if the Company cancels your Program for any of the above-mentioned reasons and you are not eligible for refunds, neither partial nor in full, of payments already made by you to the Company.

3.9 Changing booking details of your Program

Booking detail changes are:
i. Date changes
ii. Change of the Program type or length
iii. Changes and cancellations related to your accommodation
All changes are subject to availability and have to be submitted in writing to:

3.9.1 Changing booking details before your Program start

After you have received our reservation offer and you have sent us the deposit for your program, you have officially registered for a program with the Company and your program is considered as booked. If you want to change the booking details of your program, the following applies:

3.9.1.1 30 days Deadline

If the Company receives your request no later than 30 days before your program start date, changes are free of charge and simply subject to availability.

3.9.1.2 Less than 30 days before your Program Start

If the Company receives your request less than 30 days before your program start date, the following terms apply:
i. Date Changes
If you want to change the start date of your program, all program types up to and including 12 days of length will be considered as canceled and there are no refunds, neither partial nor in full, of payments made by you to the Company. For all longer programs, 50% of the program deposit will be forfeited and the balance amount, together with any other payments you have made in relation to your program, can be either credited to a future program or service offered by the Company or refunded. Replacement programs must be commenced no later than 12 months after your initial program start date as specified on your initial booking confirmation, otherwise, your deposit and any other payments you have made in relation to your program will be forfeited. Refund requests are subject to the standard PayPal fees.
ii. Program Changes
If the program duration of your newly chosen program is longer than the program you originally booked and you keep your original program start date: you are obliged to pay the difference in price. No administration fee applies. This option is subject to availability. If the program duration of your newly chosen program is shorter than the program you originally booked and you keep your original program start date:
you are obliged to pay for the accommodation costs related to your original program booking plus the program costs of your new program. An administration fee of US$ 60 (+ tax and service charge) applies. If you want to change the length and start date of your program: section 3.9.1.2 (i) “Date Changes” applies. If the program duration of your newly chosen program is shorter than the one you originally booked and you keep your original program start date: you are obliged to pay for the accommodation costs related to your original program booking plus the program costs of your new program. An administration fee of US$ 60 (+ tax and service charge) applies. If you want to change the length and start date of your program: section 3.9.1.2 (i) “Date Changes” applies.
iii. Accommodation Changes and Cancellations
If you have booked accommodation with the Company as part of your program and would like to change rooms within the accommodations the Company offers, you have to pay for the room upgrade if the room is of higher value and you may ask for a refund if the room type you choose is of lower value. If you, for whatever reason, cancel your accommodation, you are obliged to pay the full program price quoted on your booking confirmation and you have to cover all costs related to your new accommodation. There are no refunds, neither partial nor in full, of payments made by you to the Company.

3.10 Changing booking details after Program Start

3.10.1 Program Changes initiated by the Physician

After having reviewed and assessed your state of health in the initial consultation, our Physician might suggest changing your program. If you agree to the program change and availability has been confirmed to you, you have to pay the difference in price if the alternative program is of higher value. Payment is due before the Company begins to make arrangements for your new program. If the alternative program suggested by the Physician is of lower value, the difference in price will be refunded or credited to your bill. No administration fee applies.

3.10.2 Program Changes initiated by you

If you, for whatever reason, change the length and/or type of your program on the first day of your program or anytime thereafter, you have to pay the difference in price if the alternative program is of higher value. If you choose an alternative program of lower value, no refund will be given, neither partial nor in full, of payments made by you to the Company and, in case you have not paid for your initially booked program, you are obliged to pay the full program price quoted on your initial booking confirmation. Program changes are subject to availability.

3.10.3 Accommodation Changes and Cancellations

If you have booked accommodation with the Company and would like to change rooms within the Company’s premises (subject to availability), you have to pay for the room upgrade if the room is of higher value and you may ask for a refund if the room type you choose is of lower value.
There are no refunds, neither partial nor in full, of payments made by you to the Company if you, for whatever reason, cancel the accommodation that you have booked with the Company. In case you have not yet paid for your program in full, you are obliged to pay the full program price quoted on your initial booking confirmation and cover all costs related to your new accommodation by yourself.

4. Other Services: Ayurvedic Consultations & Treatments; Theta Healing; Coaching; Yoga – Taiji – Meditation

4.1 Payment

Payment is required in advance in full through PayPal, Credit Card, or Cash at the time you accept the appointment. For PayPal payments are subject to 4% transaction fees added to the service fee.

4.2 Cancellations

Cancellations are accepted via email no later than 24 hours prior to your scheduled appointment.

4.3 Refunds

You are entitled to a full refund of the service fee paid if you cancel a service that was not part of a course of single treatments or treatment combination at least 24 hours prior to your appointment. There are no refunds, neither partial nor in full:
• if you cancel your appointment less than 24 hours prior to your appointment time
• if you do not appear for your appointment
• if you cancel your appointment anytime during the delivery of the service
• after you have received the service
Single treatment fees or single treatment combination fees apply if you cancel a treatment(s) or treatment combination(s) that was or were part of a course of treatments or a treatment combination.
Refunds related to payments made via PayPal are free of charge up to 160 days from the transaction date. Any refund request submitted later than160 days after the transaction date is subject to a 4% transaction refund fee plus the standard PayPal transaction fees.

4.4 Arriving late

Arriving late for your appointment might result in reduced service time. No refunds are given if the Company finishes the service at the scheduled time and if, by doing so, the duration of the service is reduced due to your late arrival for your service appointment. You are not entitled to claim any service or product from the Company to recover reduced service time due to your late arrival.

4.5 Herbal Prescriptions

Not included in the Ayurvedic consultation service fee are costs for herbs prescribed or any other services.
